Terms of Service

Please read these Terms of Service ("Terms") carefully before using illumiTutor, operated by Illumitry Pte. Ltd. ("Illumitry", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using illumiTutor in any way, you confirm that you are at least 18 years of age, or that you are the parent or legal guardian of a minor and are accepting these Terms on that minor's behalf. Use of the Service by anyone under 18 without parental consent is prohibited.

2. The Service

illumiTutor is an AI-powered educational marking platform. Parents and guardians may upload photos of student assessment work; the Service processes those images using artificial intelligence to generate annotated feedback aligned to the Singapore MOE curriculum. Outputs are automatically generated and are provided for informational and educational purposes only.

3. Account Registration

You must provide accurate, current, and complete information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you create student accounts linked to your parent account, you remain fully responsible for their use of the Service.

4. Credits and Payments

The Service operates on a credit-based model. Credits are purchased in advance and consumed when the Service processes submissions. All credit purchases are non-refundable except where required by applicable law. Credits do not expire while your account remains active. Illumitry reserves the right to change credit pricing with reasonable notice.

5. Acceptable Use

You agree not to:

  • Upload content you do not own or have the right to use
  • Attempt to reverse engineer, scrape, or extract data from the Service
  • Use the Service to train competing AI models or datasets
  • Attempt to circumvent, disable, or interfere with any security or AI safety features
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

6. AI-Generated Content

The marking feedback generated by illumiTutor is produced by artificial intelligence and is provided for informational and educational purposes only. It is not a substitute for advice from a qualified teacher or educational professional. AI outputs may contain errors or inaccuracies. You should exercise your own judgment before relying on any output of the Service. Illumitry expressly disclaims all responsibility for any errors in AI-generated marking or feedback.

7. Intellectual Property

The illumiTutor platform, including its software, design, branding, and marks, is owned by Illumitry Pte. Ltd. and protected by applicable intellectual property laws. You retain ownership of any content you upload. By uploading content to the Service, you grant Illumitry a limited, non-exclusive, royalty-free licence to process and store that content solely for the purpose of delivering the Service to you. This licence terminates when you delete your content or close your account.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ILLUMITRY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ILLUMITRY PTE. LTD. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY.

IN NO EVENT SHALL ILLUMITRY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING UNDER THESE TERMS EXCEED SGD 0. YOU ACCEPT THE SERVICE ENTIRELY AT YOUR OWN RISK.

11. Termination

Illumitry may suspend or terminate your access to the Service immediately, without prior notice or liability, for any breach of these Terms or for any other reason at our sole discretion. You may cancel your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service ceases immediately. Unused credits are non-refundable on termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. We comply with the Personal Data Protection Act 2012 (PDPA) of Singapore. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
